Proposed bylaws amendments

Two amendments to our current bylaws are being proposed.

For your information, the proposed amendments and the current Kimberley North Improvement Association bylaws are posted on our website.

Why is this amendment being proposed?

One of the responsibilities of the Kimberley North Improvement Association is to collect annual dues from homeowners. Most homeowners pay their dues on time. However, each year some are delinquent despite multiple attempts to collect these dues. In some cases, the Association incurs legal expenses in the process of attempting to collect from delinquent homeowners. Our current bylaws do not stipulate that we can recover legal expenses or other costs associated with collecting on delinquent accounts from the homeowner.

The proposed amendments will update the Association Bylaws and the Covenants and Restrictions and allow for those costs to be recovered to the Association.

What are the requirements for these amendments to be passed?

  • We need the approval of 2/3 (two-thirds) of the homeowners eligible to vote
  • Eligible homeowners must submit their vote in writing.

What is the voting process?

  • Review the proposed amendments carefully.
    • The proposed amendments (and ballot) have been/will be mailed out with the annual meeting notice and again with dues notices by John P. Carroll Company.
    • You can also download the proposed amendments (and your ballot) here.
  • Fill out the ballot with your name, Kimberley North address, your vote, and your signature.
  • Return your completed ballot to John P. Carroll Company
  • or bring the ballot with you to the Annual Meeting on February 10th, 2015.

Instructions for filling out your amendments proposal ballot.

  • You must provide your address (number and street). Only one vote per home.
  • Include the sub you live in – Kimberley North 1, 2, or 3 and your lot number. We realize that most people won’t know those so we created maps for these. You can use these maps to find your sub number and lot number.
